This Privacy Policy applies to your use of the FastBar service (the “Service”) available through the FastBar website (the “Site” or “Website”) and mobile applications (the “Apps”), which are owned by FastBar Technologies, Inc. (“FastBar,” “we,” or “us”).

FastBar is committed to protecting your privacy and maintaining the confidentiality and security of your personal information. We provide this Privacy Policy to make our users aware of the steps we take to ensure the security of their data when utilizing our Service. This policy describes the types of information we collect when you use the Site or Apps, how we use and protect that information, how long we retain it, and with whom we share it. It also explains what your rights and options are as they pertain to privacy. By using the Site or Apps, you consent to our collection and use of your information as described in this Privacy Policy.

This policy describes:

  2. How we use, share, and protect that information;

  3. How long we retain that information; and

  4. Your rights and options regarding the information we collect

NOTE: This Privacy Policy further incorporated into and is subject to the FastBar Terms of Service Agreement.

1. Information We Collect

When you register on the Site or via the Apps, we may collect the following types of information:

(a) Personal Information: Personal Information is information that personally identifies one individual from another. You voluntarily provide this information to us when you use the Service. Depending upon how you use FastBar, we may ask you to provide us with some or all of the following elements of Personal Information: (i) Name; (ii) Phone Number; (iii) Email Address; and (iv) Street Address. We may also ask you to provide payment information in order to make purchases at the event you are attending.

We may also collect Personal Information about you if you choose to access the Service via Facebook or other social networking platforms. If you do so, you are granting us permission to access and use Personal Information that is associated with your Facebook or other social networking account, which may include information such as your name, email address, gender, age, picture, friends’ names, user Ids, connections, and any similar information.

If you access the Service via the Site, we may record your computer IP address, and may tie it to your specific account. Under ordinary circumstances, an IP address recorded in isolation is not Personal Information under the standard definition of the term. However, it may become Personal Information when it is combined with other information, as in this case. If you utilize the Apps, we may record your unique device identifier (or "Unique Device ID"), which is an alpha-numeric string of data that can either be part of the hardware of your device or automatically assigned to your device by the operating system or software. When you log on to your account, we may record your Unique Device ID and may tie it to your specific account. As with an IP address, a Unique Advice ID recorded in isolation is not Personal Information under the standard definition of the term. However, it may become Personal Information when it is combined with other information, as in this case.

Why do we collect Personal Information? We use the Personal Information we collect from and about you to enable you to utilize the Service, and to send you informational and promotional messages via email or text. You may stop receiving promotional emails from us by clicking the unsubscribe link at the bottom of the email. With your consent, we may also use your phone number to send you text messages. You may opt-out of receiving text messages by replying with the word “Stop” to any message you may receive. We also use Personal Information to analyze how you used the Service at an event in order to improve your experience at future events, and we may send you promotional messages and targeted offers.

(b) General Information: General Information consists of information that is anonymous in nature and does not identify you as an individual. When you visit our Site, General Information is collected through a small piece of computer code called a “cookie,” and could include your computer IP address, unique mobile device identifier, browser type, ISP or carrier name, and the URL of the last webpage you visited before visiting our website. When you utilize the App, our servers may automatically record certain information, which is sent by your mobile device and stored in log files. This may include your mobile device push notification identifier, operating system, carrier name, and similar data. 

Why do we collect General Information? We collect General Information to gain insight into how our Service is used. We use these insights for a number of business purposes, including auditing, research, and analysis in order to maintain, protect and improve the Service; ensuring the technical functioning of the Site and Apps; and developing new features. Such information gives us insights on how our users use our Site and our Services. We use this information to ensure that our Service continues to appeal to our users.

(c) Usage Information: We also collect information regarding the manner in which users utilize the Apps, such as application version, device manufacturer and OS version, timestamp, language used, and other statistical information.

Why do we collect Usage Information? We use this information to ensure that our Service continues to appeal to our users, and for a number of other purposes, including auditing, research, and analysis in order to maintain, protect and improve the App; ensuring the technical functioning of the App; and developing new products.

(d) Location Tracking: The App may collect and process information about your actual location using various technologies, including IP address, GPS, and other sensor that may, for example, provide us with information on nearby devices, Wi-Fi access points and cell towers. The location-based service offered in the App is for individual use only and should not be used or relied on as an emergency locator system, used while driving, or operating vehicles, or used in connection with any hazardous environments requiring fail-safe performance, or any other situation in which the failure or inaccuracy of use of the location-based services could lead directly to death, personal injury, or severe physical or property damage.

Why do we track your location? The Apps may require your location information for one or more features to work. Where the App does collect precise information about the location of your device, it will be used to provide location services for the App, and for other purposes, including, but not limited to, the provision of event-specific information. 

Opting Out: You can manage your location preferences and opt out of location tracking by declining or disabling the GPS services for the App on your mobile device.

2. How We Share information

We share information, including Personal Information, with third parties in the following manner:

(a) We may provide some Personal Information and General Information to our subsidiaries, affiliated companies, or other businesses or persons for the purpose of processing and/or storing such information on our behalf. We necessarily have to share your Personal Information with such third parties as may be required to perform their functions, such as payment processors and email service providers. We require that these parties process such information with due diligence. We also use reasonable efforts to limit their use of such information and to use other appropriate confidentiality and security measures.

(b) We may also share your information (including Personal Information) with event organizers, promoters, and other third parties, at our discretion. They use this information to determine the types of people who attended their events and the purchases they made at the event using the Service. These parties may attempt to contact you for promotional purposes, unless you provide instructions to the contrary.

(c) If requested or required by law enforcement authorities, courts, or regulators, we may disclose any information we have about our users. We also may disclose your Personal Information to exercise or protect legal rights or defend against legal claims.

(d) In some cases, we may choose to buy or sell assets. In these business transfers, customer information, including Personal Information, is typically one of the business assets that are transferred. Moreover, if all or substantially all of our business assets were acquired, or in the unlikely event that we go out of business or enter into bankruptcy, customer information (including your Personal Information), would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any assets may continue to be used according to your Personal Information as set forth in this policy.

3. How We Protect Information

We understand the importance of keeping your information safe and secure. We take what we believe to be reasonable steps to protect the information that we store. However, no method of transmission over the Internet, or method of electronic storage, is 100% secure. We cannot guarantee that your information will not be accessed, disclosed, altered, or destroyed by breach of any of our physical, technical, or managerial safeguards. We cannot assume responsibility or liability for unauthorized access to our servers and systems.

4. How Long We Keep Information

The reserve the right to keep information for our internal business purposes for as long as we are legally permitted to do so. We may also choose to anonymize certain of the information you provide to us so that it can no longer be attributed to you if we would like to retain it for longer periods of time.

5. Your Choices

You may choose how we use the Personal Information you provide to us by revoking your consent to receive promotional emails, text messages, and push notifications.

6. Children under 13

Our Service is not intended for users under the age of 13, and we do not knowingly collect any personal information from children under 13. If we become aware that someone submitting information is under 13, we will attempt to delete the information as soon as possible. According to our Terms of Service, all users represent that they are at least 13.

7. Online Tracking Technology and Do-Not-Track Requests

We employ certain technologies such as Google Analytics that enable us to track your online activities on our Site over time, and to a certain extent across third-party websites. We reserve the right to utilize those technologies for tracking purposes, and currently do not participate in any frameworks that would allow us to respond to Do-Not-Track requests. You can prevent Google Analytics from recognizing you on return visits to this Site by disabling cookies on your browser.

8. Third-Party Links

Our Site and the Apps may contain links to websites operated by third parties over which we have no control. Should you click on a link to a third-party website, the Privacy Policy of that website will solely apply to your activity. FastBar offers no guarantees on the safety or suitability of websites featured on third party links, and any user who chooses to follow such links does so at his or her own risk.

9. For California Users

In addition to the rights set forth in this Privacy Policy, Residents of California ("California Users"), may request information regarding the types of personal information we share with third parties for direct marketing purposes, and the identities of the third parties with whom we have shared such information during the immediately preceding calendar year. California Users may request further information about our compliance with this law by sending us a message via the Contact Us link on the Site. Please note that we are only required to respond to one request per customer each year concerning this law, and we are not required to respond to requests made by means other than through the Contact Us page on our website.

Further in compliance with the California Online Privacy Protection Act (CalOPPA) be advised that there is no identity verification requirement to access the Website, and all users can visit this site anonymously, but users must register on the Site or via the Apps in order to use our Service, or to communicate with us regarding our mobile applications.

10. Changes to this Privacy Policy

We reserve the right to amend, alter, or otherwise change this Privacy Policy at our sole and absolute discretion. If we make any changes regarding the disclosure of Personal Information to third parties, we will inform all registered Users by posting a prominent notice on our Site. Further use of the Service following any such change constitutes your agreement to follow and be bound by the amended Privacy Policy.
